The US Supreme Court upheld Oregon’s assisted suicide Law known as the Oregon Death With Dignity Act. The decision was 6-3 in favor of the law. The three dissenting Justices were Scalia, Thomas and Roberts (we can guess how Alito would have voted if he was on the bench). The law came into effect after Oregon voters approved it twice in statewide referendums. Conservatives reacted angrily to the ruling as it struck down one of Bush administration’s signature policies regarding what President Bush calls the "culture of life." The Supreme Court’s decision removes the last legal cloud hanging over Oregon’s Death With Dignity Law. I wonder how much influence the Terri Schiavo case had on the six Justices who voted yes.

i hadn’t thought about the impact of shiavo on the justices. hopefully they will similarly seek to protect their turf in the upcoming wiretap cases (though that’s probably more an instance of executive usurpation of legislative power than executive power).

I think that the recent shenanigans involving the NSA, the repeated overreaching by the Justice Dept, increased meddling by the religious right etc. must have given pause to Justices Kennedy and O’Connor. These two (not Scalia and Thomas) may have some regret about their roles in the 2000 presidential (s)election.
