A little over three months ago, I described the weird case (and the lawsuit) involving an anonymous blogger from Texas who used the handle Frank Pasquale for posting at his own site where among other things, he writes about problems in our health care system, particularly those involving the Paris Regional Medical Center, a hospital in Paris, Texas. You may recall that the blogger identity the anonymous writer used also happens to be the name of a law professor who blogs under his "real" name, frequently on legal and ethical issues involving medical practice.

The blogger, who also called himself fac_p, was sued by the Essent Healthcare Inc. of Nashville, Tennesse (owner of the Paris hospital) for defamation. In the lawsuit Essent demanded to know the true identity of the blogger. At issue were the free speech and privacy rights of the blogger. Well, I have just learnt that the anonymous Frank Pasquale/fac_p has won the court case, thus preserving his right to remain anonymous. Daniel J.   1. From the comments section in Solove’s blog, it looks like fac_p was unmasked after the trial and turned out to be the step-daughter of the Schaeffers, Cahill’s rivals.

    That was an anonymous blogger in another case (Doe vs Cahill) in Delaware, 2005 who was exposed. As of now, Frank Pasquale / fac_p of Texas remains anonymous.

    The Frank Pasquale case and his attempts to sue over identity theft directly parallel the efforts of KingCast/Brian Jesseman to discover who did the exact same thing to him — putting materially false words in his mouth — relating to failed NH HB 1428 for “Bruce McKay Highway.” This was an attempt to honor a cop who was on some kind of medication that the State won’t tell us, and who turned rogue.
